Houston Mayor Directs Police to Limit Cooperation With ICE

Why It Matters

Houston Mayor John Whitmire has ordered the Houston Police Department to narrow when officers cooperate with federal immigration officials. The directive changes how the department handles administrative warrants issued internally by the Department of Homeland Security.

What Happened

Whitmire issued an executive order directing Houston police to contact Immigration and Customs Enforcement only when an arrested person faces a jailable offense and has an administrative ICE warrant.

The previous policy required Houston police to notify ICE when National Crime Information Center searches identified people with administrative ICE warrants. Houston Police Chief Noe Diaz described how the revised approach would apply to routine encounters, including traffic stops that result only in citations.

“For example, if our police officers pull someone over for a minor traffic infraction and they write a citation, that person receives a citation and goes about their day,” Diaz said.

Whitmire also called on Congress to change federal immigration rules. He had previously resisted similar changes because of concerns about a federal response.

The policy follows the fatal ICE shooting of Lorenzo Salgado Araujo, a 52-year-old man driving to work in Houston. Officials said Araujo was not the intended target. An ICE officer was also charged with aggravated assault with a deadly weapon after allegedly hitting a man with a vehicle in Texas.

Austin has begun implementing a similar policy change. The issue has also become part of a broader dispute between Texas cities and state officials over cooperation with federal immigration enforcement.

Greg Abbott threatened to remove millions in funds from Houston, Dallas and Austin unless their police departments fully cooperated with federal immigration officials. The source material also states that Democrats won both chambers of Congress in Tuesday’s midterm elections, Gina Hinojosa was elected Texas’ first Latina governor and first Democratic governor since 1995, and Texas elected its first Democratic senator since 1988.

What’s Next

Houston police will apply the executive order’s narrower contact standard: an arrestee must face a jailable offense and have an administrative ICE warrant before officers contact ICE. Whitmire’s call for Congress to revise federal immigration rules remains a separate request.

“I do this to begin a healing process,” Whitmire said.
