Federal Appeals Court Lifts Pollution Order Against Chemours Along Ohio River

The 4th U.S. Circuit Court of Appeals has overturned a court order that had required Chemours Chemical Company to halt water pollution violations at its Washington Works plant along the Ohio River in West Virginia.

The ruling lifts a cease-and-desist order that a lower court had issued roughly 10 months ago. That original order came in response to a legal challenge brought by the West Virginia Rivers Coalition, which argued the company was operating in violation of its water pollution permit.

The appeals court’s decision effectively allows Chemours to resume normal operations at the Washington Works facility without the prior legal constraint. The case centers on permit compliance at one of the Ohio River’s major industrial sites, raising concerns about water quality for communities downstream.

The ruling adds to a series of legal and regulatory pressures facing West Virginia residents on environmental and utility issues. West Virginians have also been grappling with rising power bills and calls for rate relief as household costs continue to climb.

It is not immediately clear whether the West Virginia Rivers Coalition plans to appeal the decision or pursue other legal remedies.
